Liquidation Claim Filing Information

How do I file a claim against CIA?

There are two different processes for filing claims against CIA. Some claims are covered by the Florida Insurance Guaranty Association ("FIGA") while other claims can only be filed against the estate of CIA because they are not covered by FIGA.

FIGA will process loss claims covered under your commercial multi-peril or commercial automobile policy and FIGA will cover unearned premium claims on your commercial multi-peril or commercial automobile policy insurance policy that was cancelled by the liquidation order. Both claims are subject to a $100 deductible.

The process for filing a loss claim with FIGA is contact their office directly at #866-928-4310.

Premium refunds have been mailed. If you have not received a refund check for an amount over $100 and you believe you are due a refund, please contact the Receiver for assistance since their office calculated the refund amounts.

Claims for losses not covered by FIGA (amounts under FIGA's $100 deductible and amounts that over their coverage caps), surety bond claims, agent claims, employee claims, government claims and general creditor claims may become claims against the estate of CIA so long as you have a filed claim with the Receiver. On June 9, 2011, the Receiver mailed proof of claim forms to all known claimants of CIA.

What are the deadlines for filing a claim?

The Receiver's deadline for filing a claim against the estate of CIA is August 1, 2011. The deadline for FIGA to settle claims is one year after the Receiver's deadline per Section 631.68, Florida Statutes. Since the Receiver's deadline is August 1, 2011, FIGA's deadline for settling claims is August 1, 2012 unless a lawsuit was initiated.

How do I obtain a proof of claim form?

The Receiver mailing proof of claim forms on June 9, 2011. If you do not receive a proof of claim form, please contact the Receiver by using our "Contact Us" form. Alternatively, you may contact the Receiver at #850-413-3081 (toll-free to Florida Residents by calling #800-882-3054).
