Case Notes - September 2024


Case: The Bureau of Investigation opened an investigation on a life, health and variable annuity agent based on a referral from our Division of Consumer Services. The complaint alleged the agent named himself as agent of record on a consumer’s Federally Facilitated Marketplace (FFM) policy without the consumer’s knowledge and consent, and deprived another insurance agent of the consumer's business. 

During the course of the investigation, one victim told investigators that not only was his agent of record changed, but the "new" agent made changes to his health insurance policy that led to a substantial increase in his monthly premium.
Disposition:
Fined $1,750.   

Case: This case was opened based on the allegations that the public adjuster failed to maintain a surety bond as required. During the course of the investigation, the public adjuster was given an opportunity to submit an active bond but he failed to do so.

Disposition: The public adjuster's license was administratively surrendered to the Department. The former licensee shall not have the right to reapply for another license for one (1) year, and would be required to retake the public adjuster exam. 

Case: This case was opened based on information from an insurance company alleging a health insurance agent submitted dozens of applications containing inaccurate personal and banking information in order to receive advance commission payments. 
Disposition: License suspended for 12 months.
