Consumer Advocates: Don't let contractors handle insurance claims

TALLAHASSEE -- As a potentially long and arduous insurance claims process begins for hundreds of thousands of Floridianswith property damaged by Hurricane Irma,consumer advocates are warning homeowners againstallowing contractors to handletheir claims through a relatively obscure process known as assignment of benefits.

The scheme involves policyholders signing over the administration of their claims to contractors, who often agree to begin repairs immediately, without first consulting with insurance adjusters.When claims areunderpaid or rejected,contractors oftenhire lawyers tobring suits againstthe insurer, in the name of the policyholder.

Assignment of benefits claims have led to a flood of lawsuits in South Florida in recent years, causing insurance premiumsthere torise.A spike of such claims in the wakeof Irmacould causea destabilization ofthe statewide property insurance market, some expertswarn.

"They can pump it up, they can charge for work that wasn't done, they can charge for work that doesn't need to be done, lawyers get involved, lawsuits happen in your name and you have no control over it," said Bob Lotane, whoworked atFlorida's Office of Insurance Regulation beforeserving asan insurance industry consultant. "And when all these costs are factored in by the insurance commissioner, he has no choice but to raise the rates that all of us pay."

It's not just the insurance industry sounding the alarm: state regulatorsagree thatassignment of benefits arrangements, whilesatisfying homeowners'desire for a quickrecovery process, could heighten the risk that all policyholders will have to pay up later.

In a public service announcement produced in the days following Irma's landfall, Florida Chief Financial Officer Jimmy Patronis pointedly cautions homeowners against signing away their claims administration rights.

"Make sure that you read and understand every document that you're asked to sign," Patronis says in the ad. "Ask specifically who will be responsible for the payment: you, or your insurance company."

Patronis said Floridians can get questions answered by calling the Insurance Consumer Helpline at 1-877-693-5236.

But aneffort to end the assignment of benefitssystem has fallen flat in Tallahassee in recent years, withcontractors and lobbyists for the state's trial lawyers arguing thatthearrangement benefits consumersby enlisting experiencedvoices to negotiate with insurers on their behalf.

With more than 450,000 claims totaling $2.7 billion already filed in the wake of Irma, the truest test ofthe systemcouldbe about to begin.

"If we see the continued abuse with the amount of claims out there, I think that might get the legislature's attention," Lotane said.
