The Division is partnering with the U.S. Department of Labor, Office of Safety and Health Administration (OSHA) to provide employers with information relating to both workers' compensation and workplace safety. Continuing Education Units are available to individuals licensed by the Department of Business and Professional Regulation (DBPR), Construction Industry Licensing Board or the Electrical Contractors Licensing Board. The attached flyer lists class dates and locations around the State. Advanced registration is required to assure availability.

- The Florida Division of Workers' Compensation has submitted a Notice of Proposed Rule Making for Rule Chapter 69L-6.021, Florida Administrative Code, Construction Industry Classification Codes, Descriptions, and Operations Scope of Exemption. The notice [66K
PDF] provides that, if requested in writing within 21 days of the publication of the official notice, a rule hearing will be held on Tuesday, July 19, 2011 at 1:30 p.m., eastern daylight time (EDT) in room 104J of the Hartman Building. The purpose of the proposed rule is to delete discontinued class codes, add new class codes and revise the descriptions of construction class codes, as published in the Florida exception pages in the National Council on Compensation Insurance, Inc. (NCCI), Basic Manual, 2001edition. The proposed rule also adopts the corresponding definitions published in the NCCI, Scopes® of Basic Manual Classifications (February, 2011) and defines when an employer is engaged in the construction industry, for purposes of this rule. The aforementioned materials include updates through February 1, 2011. The official Notice of Proposed Rule appears in Florida Administrative Weekly, which was published on June 24, 2011.

- The Florida Division of Workers' Compensation has received a written request for rule hearing on the Florida Workers' Compensation Health Care Provider Reimbursement Manual (Rule Chapter 69L-7.020, F.A.C.) and on the Florida Workers' Compensation Reimbursement Manual for Ambulatory Surgical Centers (ASCs) (Rule Chapter 69L-7.100, F.AC.). Therefore, a rule hearing will be held on Wednesday, July 13, 2011 beginning at 9:00 a.m., Eastern Day Light Savings Time (EDT) for Rule Chapter 69L-7.020 and at 11:00 a.m. for Rule Chapter 69L-7.100 F.A.C.
The hearings will take place in room 104J of the Hartman building, which is located at 2012 Capital Circle Southeast, Tallahassee, Florida 32399. The official Notice of Proposed Rule Development appears in Volume 37, Number 24, of the Florida Administrative Weekly, which was published on June 17, 2011. - Healthcare provider responsibilities section updated
- The Florida Division of Workers' Compensation has submitted a Notice of Proposed Rule Development for the Health Care Provider Certification Rule (Rule Chapter 69L-29, F.A.C.). The notice provides that, if requested in writing and not deemed unnecessary by the agency head, a rule development workshop will be held on Wednesday, July 13, 2011 at 2:00 p.m., eastern daylight time (EDT) in room 104J of the Hartman Building. The purpose for the proposed rule development is to amend the current Health Care Provider Certification Rule for the two following reasons: to revise the process by which health care providers satisfy the minimum criteria for certification pursuant to section 440.13(3)(a), Florida Statutes; and, to introduce the "Florida Workers' Compensation Health Care Provider Certification Tutorial." The tutorial is a no-cost, on-line resource that implements an electronic certification process for health care providers that will improve efficiencies in the certification process. - Bureau of Employee Assistance (EAO) section updated
- The Florida Division of Workers' Compensation has submitted a Notice of Proposed Rule Making for the Carrier Report of Health Care Provider Violations Rule (Rule Chapter 69L-34, Florida Administrative Code). The notice provides that, if requested in writing within 21 days of the publication of the official notice, a rule hearing will be held on Thursday, June 23, 2011 at 9:00 a.m., eastern daylight time (EDT) in room 104J of the Hartman Building. The purpose of the proposed rule is to clarify the process by which Carriers shall comply with their mandate to report, to the Division, all instances of health care provider overutilization; and, to introduce an elective process for reporting a health care provider's alleged violation of Chapter 440, Florida Statutes, or of any related administrative rule. - The Florida Department of Financial Services, Division of Workers' Compensation will be presenting a webinar training opportunity, entitled "Explanation of Bill Review (EOBR), Requirements for Communicating Carrier Reimbursement Decisions". The purpose of the training is to promote a better understanding of the EOBR and to increase carrier compliance with Division rules for utilizing the EOBR in the medical bill adjudication/bill review process. The event is free, but phone lines are limited so you will need to register in order to secure access to one of the telephone lines. To register for this event, you must complete the registration form available at the link below. Spanish) was recently updated with the new CFO's letterhead and is available under Publications. In accordance with s. 440.185(11), F.S. and Rule 69L-26.004(6), F.A.C., carriers must provide this written notification to injured employees within three days after becoming knowledgeable of their work related injuries. Please ensure that the updated Employee Notification Letter is being used in your communications with injured employees.

- The Division has announced new enhancements to the Proof of Coverage Database. These enhancements will provide information relating to the number of employees reported for each employer; the governing classification code reported for each employer; and the scope of business or trade(s) listed on Certificates of Exemption.

- Rule 69L-6.007, Compensation Notice, Florida Administrative Code, has been adopted and will become effective on January 30, 2011. The rule adopts the revised workers' compensation notice posters, including the Spanish version of the poster and updates the information that is required to be included on the poster. Section 440.40, F.S., requires every employer who has secured workers' compensation insurance to post in its place of business a workers' compensation notice and an Anti-Fraud Reward Program notice. Section 440.40, F.S., also authorizes the Department, by rule, to prescribe the form of the notices and to require carriers to provide the notices to policyholders.
For a transitional period of 90 days from the effective date of the rule, an insurer or self-insurance servicing agent may use the "broken arm" posters identified and adopted in subsection 69L-6.007(1), Florida Administrative Code, or the corresponding poster(s) in effect prior to the adoption of the rule. After the completion of the 90 day transitional period, only the revised posters adopted in this rule may be used.

The Report contains the Panel’s recommendations on methods to improve the workers’ compensation health care delivery system and has been submitted to the Speaker of the House of Representatives and to the President of the Senate as required by subsection 440.13(12)(e)(4), Florida Statutes. The 2011 Three-Member Panel Report is hosted on this site under Publications and Reimbursement Manuals.

- Rule Amendment for the Division of Workers’ Compensation
Rule 69L-3.025, Forms, Florida Administrative Code, has
been adopted and became effective on November 30, 2010. The rule as
amended, adopts revised English and Spanish informational brochures
that carriers are statutorily required to mail to injured employees
within three (3) days of receiving notice of their injuries. The
amended rule also adopts revised English and Spanish informational
brochures that carriers are statutorily required to mail to

(EOBR) and evaluation component to its claims audits effective
January 1, 2011. The EOBR provides the health care with the
reason(s) for an insurer’s reimbursement decisions. Florida EOBR
requirements can be found in Rule 69L-7(5) (o) and (q), Florida

that are held in various locations around the State. These seminars
are free and open to all employers who are interested in

by the U.S. Department of Labor, Office of Safety and Health
Administration (OSHA) who will provide employers with basic

- The Division of Workers' Compensation has issued a
Notice of Proposed Rule Development of
Rule 69L-3.025, F.A.C. The purpose and effect of 69L-3.025,
F.A.C. is to specify departmental forms used with the rule chapter.
This proposed forms change deals specifically with the informational
brochures that carriers are statutorily required to mail to injured
employees and employers.

- A Hearing on the Notice of Proposed Rule Amendment for the
Division of Workers' Compensation Rule 69L-6.007,
Compensation Notice, Florida Administrative Code, will be
held, if requested, within 21 days of the date the Notice was
published. Section 440.40, F.S., requires every employer who has
secured workers' compensation insurance to post in its place of
business a workers’ compensation notice and an Anti-Fraud Reward
Program notice. Section 440.40, F.S., also authorizes the
Department, by rule, to prescribe the form of the notices and to
require carriers to provide the notices to policyholders. Currently,
Rule 69L-6.007, F.A.C., requires carriers to furnish employers with
a compensation notice, commonly referred to as the "broken arm

requested, it will not be held.

rule was published in the September 10, 2010 edition of the Florida

- Rule 69L-6.026, Periodic Reports Rule, Florida
Administrative Code, has been adopted and will become effective on
September 15, 2010. The adopted rule establishes procedures for
filing periodic reports by employers issued Stop-Work Orders for
failing to comply with the coverage requirements of Chapter 440,
F.S., where assessed penalties exceed $50,000.00. As a condition of
release from a Stop-Work Order, subject employers must submit
quarterly reports to the Department using new form DFS-F4-2018,
"Bureau of Compliance Quarterly Report Form," or in an electronic
format via the Division’s website to document their continuing
compliance with the coverage requirements of Chapter 440, F.S.

- The Division will conduct a Rule Development Workshop for the
Florida Workers' Compensation Health Care Provider Reimbursement
Manual (Rule Chapter 69L-7.020, F.A.C.) and the Florida Workers'
Compensation Reimbursement Manual for Ambulatory Surgical Centers
(ASCs) (Rule Chapter 69L-7.100, F.AC.) on 9/16/2010 in room 104J of
the Hartman Building. The Workshops will begin at 9:00 a.m., and
11:00 a.m., respectively. The purpose of the Workshops is to adopt
2010 versions of the Florida Workers’ Compensation Health Care
Provider Reimbursement Manual (HCP RM) and of the Florida Workers’
Compensation Reimbursement Manual for Ambulatory Surgical Centers
(ASC RM). The 2010 Editions of the HCP RM and of the ASC RM will
implement the reimbursement rates authorized by the Three Member
Panel, pursuant to
Section 440.13(12), F.S.

- The Bureau of Compliance is offering Deepwater Horizon Oil Spill
Workers' Compensation Compliance Seminars in the Florida panhandle.
Topics to be addressed will include Florida workers’ compensation
coverage requirements, independent contractors, employer/employee
relationships, out of state employer coverage requirements, and US
Longshore & Harbor Workers Act enforcement authority. See

- The Division of Workers' Compensation has developed several
web-based benefit calculators,
available in the Employee section.
The calculators can be used by anyone, but are specifically designed
to assist injured employees in estimating their wage replacement
benefits. They are highly interactive and will assist injured
employees in understanding how temporary disability and impairment
benefits are determined.
In addition, the calculators include links to the relevant sections in
Chapter 440, F.S., and Rule 69L, F.A.C, that further educate injured
employees on wage replacement benefits.
- The Division's Bureau of Compliance is pleased to publish its
inaugural Quarterly Newsletter. This Newsletter provides the Bureau
with an opportunity to share its activities, new initiatives,
administrative rule changes and updates as well as general
information. The Bureau will publish a quarterly newsletter at the
conclusion of each quarter.

Administrative Code, has been adopted and will become effective on
July 5, 2010. The rule, as amended, authorizes the immediate
revocation of a Certificate of Election to be Exempt for any
corporation engaged in the non-construction industry that becomes
dissolved or inactive. The amendment also provides for the immediate
revocation of Certificates issued to persons engaged in the
non-construction industry that are no longer meeting the exemption
eligibility requirements.

Division of Workers’ Compensation Rule 69L-6.026, Periodic
Reports, Florida Administrative Code, will be held on
Thursday, July 15, 2010 @ 10:00 am in Room 104J, Hartman Building,
2012 Capital Circle SE, Tallahassee, Florida. The purpose of the
proposed rule is to establish procedures for filing periodic reports
by employers issued Stop-Work Orders for failing to comply with the
coverage requirements of Chapter 440, F.S., where assessed penalties
exceed $50,000.00. As a condition of release from a Stop-Work Order,
subject employers must submit quarterly reports to the Department
using new form DFS-F4-2018, “Bureau of Compliance Quarterly Report
Form,” to document their continuing compliance with the coverage
requirements of Chapter 440, F.S.

Compensation Notice, Florida Administrative Code, will be
held on Tuesday, June 29, 2010 @ 1:00 pm in Room 2100, Alexander
Building, 2020 Capital Circle SE, Tallahassee, Florida. Section
440.40, F.S., requires every employer who has secured workers'
compensation insurance to post in its place of business a workers'
compensation notice and an Anti-Fraud Reward Program notice. Section
440.40, F.S., also authorizes the Department, by rule, to prescribe
the form of the notices and to require carriers to provide the
notices to policyholders. Currently, Rule 69L-6.007, F.A.C.,
requires carriers to furnish employers with a compensation notice,
commonly referred to as the "broken arm poster" and incorporates the
Anti-Fraud Reward Program notice poster. The purpose of the proposed
rule amendment is to update the rule and adopt the revised workers'
compensation notice posters, including the Spanish version of the
poster.

- The Division is offering free classes to educate employers,
business owners, licensed contractors and other interested
stakeholders to help them understand their statutory obligations
under the Workers' Compensation Law. The Division is partnering with
the U.S. Department of Labor, Office of Safety and Health
Administration (OSHA) to provide employers with information relating
to both workers’ compensation and workplace safety. Continuing
Education Units are available to individuals licensed by the
Department of Business and Professional Regulation, the Department
of Financial Services, Bureau of Fire Prevention and the Florida
Water Well Administration. The attached flyer lists class dates and
locations around the State. Advanced registration is required to
assure availability.

not take the place of required fees owed to the Division for
processing exemption applications. These solicitations direct you to
a website that IS NOT the Division's website. The Division of
Workers' Compensation is the sole authority that is responsible for
processing and approving workers' compensation exemption
applications.

- Rule Chapter 69L-5, F.A.C., Rules for Self-Insurers Under the
Workers Compensation Act, has been amended to concurrently repeal
and replace all existing rules with new rules which have been
restructured and renumbered to promote clarity and efficiencies to
the process by which self-insured employers comply with the duties
and obligations associated with the privilege of self-insuring
pursuant to Chapter 440, Florida Statutes.
The final adopted version of this rule is effective March 9, 2010. A

secure an annual actuarial report on the liabilities of the Special
Disability Trust Fund (SDTF). The Department selected
Pinnacle Actuarial Resources, Inc. (Pinnacle), as the
independent actuary to perform this service. Pinnacle has submitted
its report titled: Actuarial Valuation of the Florida Department
of Financial Services Division of Workers' Compensation Special
Disability Trust Fund, Actuarial Analysis as of June 30, 2009.
This is the third report in the series authored by Pinnacle. The
report includes all required elements and other such information
necessary to understanding the status of the SDTF and the analysis
performed.
