CFO Atwater Announces Agreement with Employee who Illegally Obtained Government Assistance

TALLAHASSEE--Florida Chief Financial Officer, Jeff Atwater, along with State Attorney for the Tenth Judicial Circuit of Florida Jerry Hill, today announced a plea agreement entered by Rosalind McCutchen Loften of Fort Meade, Florida. The plea was a result of an investigation by CFO Atwater’s Department of Financial Services Office of Fiscal Integrity (OFI) and 2011 arrest of Ms. Loften.

 “It is unacceptable for anyone entrusted with the Florida taxpayers’ dollars to misappropriate funds for personal gain from programs specifically intended to assist those in need,” CFO Atwater said. “Our department is committed to aggressively pursuing those who commit financial crimes against our state.” 

The investigation by OFI found that Rosalind Loften, between January 2008 and June 2010, misused her position with The Agriculture and Labor Program, Inc. (ALPI), to illegally obtain government funded energy assistance payments totaling more than $15,000 for herself as well as for family members and others who were ineligible for the services.

OFI detectives found that Loften while employed at ALPI created energy assistance application files containing fabricated, fraudulent and sometimes fictitious documents which generated the illegal payments. False documentation in the applicant files included understated incomes and forged applicant signatures. 

In her plea agreement Rosalind Loften pled guilty to grand theft and faces 48 months of probation with adjudication withheld.  

Chief Financial Officer, a statewide elected official, oversees the Department of Financial Services.  CFO Atwater’s priorities include fighting financial fraud, abuse and waste in government, reducing government spending and regulatory burdens that chase away businesses, and providing transparency and accountability in spending.
