Proof of claim forms have been mailed. The claims
filing deadline was February 15, 1994. Any proof of claim form
received after the claims filing deadline was considered "late filed".
In
1994, the First Interim Claims Report was filed and approved by the Second
Judicial Circuit Court in and for Leon County, Florida ("Court") to resolve
claims made by Class 5 claimants, which were, at that time, the employees of
the company.
On October 12, 2005, the Second Interim Claims Report was filed with the Court
in the estate of Union General. On October 14, 2005, the Court issued
an order approving the report. On November 4, 2005, notices were sent
to 8,011 claimants who filed a proof of claim with estate of Union
General. The notice informed the claimants of the Receiver's
recommendations concerning the classification and amount of their claim,
along with instructions on how to proceed if the claimant objected to the
recommendations. Objections were required to be filed by the claimant,
in writing, with both the Court and the Receiver and postmarked by
December 16, 2005. Objections filed after that date were not
considered. All objections have been resolved.
On July 21, 2006, the Receiver's Motion for Approval of the Final Claims Report, Claims
Distribution Report, Distribution Accounting and for Order Authorizing Distribution, was filed
with the Court. On July 29, 2006, the Court issued an order granting approval for the Receiver
to mail distribution checks representing 100% of the recommended and adjudicated amount to claimants
Classes 1, 2, and 3. As a result of the order, 3,792 claimants were approved to
receive a distribution check. On August 22, 2006, distribution checks were mailed.
The majority of the distribution checks represented the $100.00 statutory
deductible applied by the Florida Insurance Guaranty Association ("FIGA") in their
settlement of claims within this estate.
It is unknown at this time when a subsequent distribution will take place for claimants
in Classes 4 through 10.
All undelivered distribution checks from the August 2006 distribution have been sent to the Department of Financial Services, Bureau
of Unclaimed Property. The Bureau of Unclaimed Property may be reached at:
