I have a claim for return of unearned premium for my Workers’ Compensation policy. What do I do?
The process of returning unearned premium on a workers compensation policy is time consuming and involves completing a premium audit to determine the true amount of unearned premium on the policy. Claims for return of unearned premium on policies that were in force as of the liquidation date may be covered by the Florida Workers’ Compensation Insurance Guaranty Association ("FWCIGA").
For FWCIGA covered policies (Florida policy in force as of the date of liquidation), it is anticipated that unearned premium refund checks will start getting mailed in May 2010 once FWCIGA receives the refund data from the Receiver. If by the end of May 2010 you have not received a refund check and feel you are due a refund, please contact the Receiver to see if they calculated a refund on your policy.
Unearned premium claims for policies that were not in force as of the liquidation date are not covered by FWCIGA but may become a claim in the First Commercial estate. The Receiver has received court approval to deem file unearned premium claims not covered by FWCIGA. To view a copy of the order, click here. No action is required by unearned premium claimants.
