On August 6, 2008, America’s Health Choice Medical Plans, Inc, (“AHC”) was ordered into receivership for purposes of rehabilitation by the Second Judicial Circuit Court (”Court”) in Tallahassee, Florida. The Florida Department of Financial Services is the court appointed Receiver of America’s Health Choice.

Headquartered in Vero Beach, Florida, AHC has no current subscribers. AHC was initially licensed as a Provider Sponsored Organization in 2000 and converted its license to a Health Maintenance Organization in 2004. The company was authorized to sell Medicare products. Medicare funds and contracts are administered through a federal agency, the Centers for Medicare and Medicaid Services ("CMS"). In July, 2007, CMS terminated AHC’s Medicare Advantage-Prescription Drug contract and asked another company to immediately provide health coverage to all of AHC’s Medicare members. Since that time, AHC has essentially been in a “runoff” mode, paying the remaining claims of its former subscribers.

In February, 2008, AHC agreed to public administrative supervision under the direction of the Florida Office of Insurance Regulation (“OIR”). As part of the Consent Order for Public Administrative Supervision with OIR, AHC consented to receivership under the grounds which subsequently led to this proceeding.

During rehabilitation, the Receiver will continue to process claims in the ordinary course of business to the extent possible.
