What is the status of my pending claim?
Processing and payment of commercial multi-peril and commercial automobile covered claims are being handled by the Florida Insurance Guaranty Association (you are leaving the DFS website and opening a new browser window) ("FIGA"). FIGA pays covered claims up to a maximum of $300,000 per claim. Additionally, there is a $100 statutory deductible per claim. You may call FIGA at (800) 988-1450 to find out the status of your claim.
If I reported my claim to First Commercial, must I start over with FIGA?
No. FIGA has access to the company claim files and will handle your claim.
How much will be paid on my claim?
FIGA will pay covered claims up to policy coverage or up to a maximum of $300,000. All claims paid by FIGA are subject to a $100 statutory deductible. Claims for the $100 deductible and/or in excess of $300,000 may be claims against the estate of First Commercial may be submitted to the Receiver by filing a proof of claim form.

There is a lawsuit being brought against me for bills that First Commercial should have paid. What should I do?
You should contact FIGA immediately at (800) 988-1450. Just as the insurance company would have done if it were still solvent, FIGA will determine if you are entitled to receive legal defense.
Do I need to submit a proof of claim form to the Receiver in order to have FIGA make payments on my loss claim?
No. FIGA has access to the company claim files and will review your claim to determine if it is a covered claim on which payments may be due. FIGA is allowed a $100 statutory per-claim-deductible; the maximum statutory FIGA payment is $300,000.
