Health Insurance Portability & Accountability ActThe following is a list of all companies that have advised the Florida Department of Financial Services, Office of Insurance Regulation that they are marketing guaranteed issue health insurance policies for eligible individuals as defined by Section 627.6487(3), Florida Statutes. Companies offer two types of guaranteed issue policies: instate and out-of-state group. Instate policies are policies that are filed and approved with the Florida Department of Financial Services, Office of Insurance Regulation. They must meet certain minimum standards regarding benefits offered. Their rates must also be approved by the Office of Insurance Regulation. Health Savings Account (HSA) availability information is provided below; however, these plans may not be available on a guaranteed issue basis. Please inquire with the insurer or HMO to determine if this plan is available per 627.6487 Florida Statutes. The following companies are currently offering in-state guaranteed issue policies:
Out-of-state group association certificates are policies that are made available by insurance companies to various interest groups that are not based in Florida. The policy terms and premium rates are not filed with the Office of Insurance Regulation because they are not being sold to a group in Florida. A Florida resident wishing to purchase such coverage may join the group that sponsors the coverage. Out-of-state group insurance certificates must contain the following disclaimer on the front page of the certificate: "The benefits of the policy providing your coverage are governed primarily by the law of a state other than Florida". Applications for certificates of coverage offered to residents of this state must contain the following statement on the same page as the applicant’s signature: "This policy is primarily governed by the laws of[insert state where the master policy if filed]. As a result, all of the rating laws applicable to policies filed in this state do not apply to this coverage, which may result in increases in your premium at renewal that would not be permissible under a Florida-approved policy. Any purchase of individual health insurance should be considered carefully, as future medical conditions may make it impossible to qualify for another individual health policy. For information concerning individual health coverage under a Florida-approved policy, consult your agent or the Florida Department of Financial Services."
