Applicants with Prior Criminal History


Pursuant to F.S. 626.611 (14), the Department of Financial Services has the authority to deny any applicant who meets any of the following, whether a judgment of guilt was withheld or not:


  • has entered a plea of nolo contendere (no contest) to a felony,
  • has entered a plea of guilty to a felony,
  • has been convicted or found guilty of a felony, or
  • has pled guilty, nolo contendere (no contest), or been found guilty of any crime punishable by imprisonment of one year or more in any state.

Applicants who fall into these categories are subject to a 5, 7 or 15 year waiting period from the date the applicant was convicted or pled to the felony (See 69B-211.042). Waiting periods are determined based on the class of the crime.


    Class A =15 year waiting period

    Class B = 7 year waiting period

    Class C = 5 year waiting period


If the applicant has satisfied the waiting period, he/she must meet the following conditions, if applicable:

  • Probation completed
  • Full payment of any court ordered restitution
  • Restoration of civil rights, if convicted

Note: Meeting the conditions above does not automatically guarantee the applicant will be granted licensure.
