ARTICLE V
The Article V Section will complete an on-site review and publish
a report detailing Clerk compliance with Florida Statutes in the
areas of the budgeting process, spending of State funds, liabilities
due to the State, and performance measures. The Article V Section is
currently assisting the Office of Program Policy Analysis and
Governmental Accountability with a study regarding costs of the
Clerk and Judicial functions.
Fines, fees, court costs, and service charges
are collected by the Clerks offices for deposit into various State
funds. A portion of these funds are deposited into the Clerks of
Circuit Court Trust Fund within the Justice Administrative
Commission and are used to fund Clerks through the State
appropriations process.
A specified percentage of all court-related fines collected by the
clerk shall be deposited in the Clerk’s Public Modernization Trust
Fund and used exclusively for additional court-related operational
needs and programs.
Florida Laws
Ch.2009-61 (SB1718) provides the 67 Clerks offices with the FY
2009-2010 budget of $451 million, through the States General
Appropriation Act (GAA). The Clerks of Court Operations Corporation
is also funded pursuant to the GAA and is responsible for allocation
of the appropriation used to fund the 67 Clerks offices.
