COMPTROLLER'S MEMORANDUM NO. 31 (1979-80)

TO: AGENCIES AND DEPARTMENTS ADDRESSED

SUBJECT: OFFICIAL CIRCUIT COURT REPORTERS - DUAL COMPENSATION

Section 216.262 (1) (d), Florida Statutes, provides that no individual employed by a State agency may receive compensation simultaneously from more than one State agency unless approved by the Department of Administration during each fiscal year. The purpose of this memorandum is to advise agencies that official circuit court reporters who are compensated pursuant to Chapter 29, Florida Statutes, are employees of the Judicial Branch of State Government.

Agencies who utilize official circuit court reporters will be required to obtain dual compensation approval from the Department of Administration in accordance with Section 216.262 (1) (d), Florida Statutes. The Department of Administration has adopted Chapter 22k-8, Florida Administrative Code, which provides for the form and process to request such approval. A copy of the Department of Administration's approval must be attached to the voucher submitted to the Bureau of Auditing for payment.
