COMPTROLLER'S MEMORANDUM NO. 23 (1994-95)

SUBJECT: MOTOR VEHICLE IMPACT FEE REFUNDS

We have been working with the Department of Highway Safety and Motor Vehicles (DHSMV) to develop and implement a plan to refund the motor vehicle impact fees. Pursuant to Section 8, Chapter 95-222, Laws of Florida, and the proviso language applicable to Line Item 1726, Chapter 95-429, Laws of Florida, DHSMV is in the process of providing each agency a file or listing of persons identified to date as eligible to receive refunds. It is imperative that each agency obtain the file or listing from DHSMV as quickly as possible. Each agency is required to provide the Comptroller with information concerning debts owed to the State and delinquent child support obligations by the persons authorized to receive impact fee refunds. If an agency does not report any debts or obligations to this office within the timeframes discussed below, we will proceed with processing the refunds under the assumption that the agency has no outstanding debts or obligations that should be reported for this purpose.

Enclosed is the file layout for providing child support obligations and debt information to this office. The information must be provided no later than August 1, 1995, to:

After the deadline of September 1, 1995, for persons to file refund applications with DHSMV, DHSMV will provide each agency a file containing additional persons identified as eligible to receive refunds. Within 10 days after receipt of this file from DHSMV, each agency is required to provide this office with an updated file of delinquent child support obligations and debts owed to the State by persons eligible to receive refunds. This updated file will replace the original file submitted to this office and must include all debts and child support obligations outstanding on the date of submission of the file, which are owed by persons eligible for refunds. The updated file must include any debts or obligations that were included in the original file submitted and are still outstanding. This information will be used in processing the final group of refunds submitted by DHSMV.

If an agency reports a debt or delinquent child support obligation to this office, we will withhold the amount from the refund and prepare a letter advising the person of the right to a hearing. If a hearing is requested, the agency which provided the debt or child support obligation will be responsible for providing a hearing.

If no hearing is requested or if the hearing affirms that the debt or child support obligation is due, we will transfer the amount withheld to the agency's designated account. We will provide the agency a file containing the information regarding the amounts withheld and transferred.

The information presented above is being incorporated into the refund plan for submission to the Court for approval. If any procedural changes are directed by the Court, we will notify agencies as soon as possible.
