On January 17, 2006, the Receiver mailed proof of claim forms to potential claimants of Western Star Insurance Company ("Western Star"). The claims filing deadline was March 17, 2006. Any claims received after the filing deadline of March 17, 2006 were considered “late-filed” and were assigned to a lower claimant class.
On June 28, 2007, the First Interim Claims Report was filed with the Second Judicial Circuit Court in and for Leon County, Florida ("Court") in the estate of Western Star. On July 6, 2007, notices were mailed to 23 Western Star claimants who filed a proof of claim in this estate. The notice informed them of the Receiver's recommendations concerning the classification and amount of their claim, along with instructions on how to proceed if a claimant objected to the recommendations. Objections were required to be filed by the claimant, in writing, with the Court and the Receiver, and postmarked by July 31, 2007. No objections were filed.
On August 11, 2007, the Court approved the Final Claims Report regarding the distribution of assets in this estate. Under the terms of the Order, Claimants in Classes 1, 2 and 3 received a 100% distribution of the adjudicated amounts of their claims. Distribution checks were mailed on September 14, 2007.
On December 27, 2007, the Court issued an Order that discharged the Florida Department of Financial Services of its duties as Receiver of Western Star effective December 31, 2007. To view a copy of the discharge order, click here.
