Proof of claim forms have been mailed.  Any proof of claim form filed after the claims filing deadline was considered "late filed".  If you submitted a proof of claim form, you have been notified in writing of the Receiver's recommendation on your claim.

On October 16, 2002, a Second Interim Claims Report was filed with the Second Judicial Circuit Court in and for Leon County, Florida (“Court”) in the estate of Trans-Florida Casualty Insurance Company (“Trans-Florida”).  On October 16, 2002, the Court issued an order approving the report.  All classes (Class 1 through Class 10) were reported, with monies being recommended on Class 1 and Class 2 only.  Notices were then sent to 4,651 Trans-Florida claimants who filed a proof of claim in the Trans-Florida estate.  The notice informed them of the Receiver’s recommendation concerning the classification and amount of their claim, along with instructions on how to proceed if a claimant objected to the recommendations.  All filed objections arising from this report have been resolved.

Due to additional assets being collected in this estate, a Third Interim Claims Report was filed with the Court in the estate of Trans-Florida on February 16, 2005.  On February 23, 2005, the Court issued an order approving the report.  On March 9, 2005, notices were mailed to 3,477 claimants who filed a proof of claim in the estate, and who, as a result of the additional assets, had a change in the Receiver’s recommended amount.  The deadline for filing objections to the recommendations was April 25, 2005.  Objections filed after that date were not considered.

On October 5, 2005, the Receiver filed a motion for approval of the Final Claims Report, the Final Distribution Report and approval to make a distribution to claimants in Classes 1 through 3.  On October 14, 2005, an order was entered that granted approval for the Receiver to mail distribution checks representing 100% of the recommended and adjudicated amount to claimants in Classes 1, 2 and 3.  As a result of the order, 3,216 claimants were approved to receive a distribution check.  The checks were mailed on November 7, 2005.  The majority of the checks amount to $100 and represent the statutory deductible that was applied by the Florida Insurance Guaranty Association ("FIGA") in the prior settlement of claims within the Trans-Florida estate.

It is unknown at this time when a subsequent distribution will take place for Classes 4 through 10.

It is the claimant's responsibility to notify the Receiver, in writing, if there is a change in their name or mailing address.  When corresponding with the Receiver, be sure to reference "Trans-Florida Casualty" and the "Receiver's Claim Number ("RCN")", which will allow the Receiver to associate your request with the correct claim and receivership.
