Proof of claim forms have been mailed. Any proof of claim form filed after the claims filing deadline
was considered "late filed". If you submitted a proof of claim form, you have been notified, in writing,
of the Receiver's recommendation on your claim.
On October 16, 2003, the First Interim Report on claims was filed with the Second Judicial Circuit Court in and for
Leon County, Florida (“Court”) in the estate of First Alliance Insurance Company (“First Alliance”). On October 20,
2003, the Court issued an order approving the report. Notices were mailed to 1,204 First Alliance claimants who
filed a proof of claim in the estate. The notice informed them of the Receiver's recommendations concerning the
classification and amount of their claim, along with instructions on how to proceed if a claimant objects to the
recommendations. Objections were required to be filed by the claimant, in writing, with the Court and the Receiver
and postmarked by December 1, 2003. Objections filed after that date were not considered. All filed objections have been
resolved.
On March 7, 2006, the Final Claims Report for the First Alliance estate was filed with the Court. On March
10, 2006, the Court issued an order approving the report.
On April 13, 2006, the Receiver filed a motion with the Court for approval of the
Final Claims Distribution Report,
the distribution accounting and approval to make a distribution to claimants in Classes 1 and 2. On April 18, 2006,
an order was entered that granted approval for the Receiver to make a distribution.
Under the terms of the order, Class 1 claimants received a 100% distribution
and Class 2 claimants received a 13.986% distribution of the adjudicated
amounts of their claims. The majority of the allowed Class 2 claims represented the $100 statutory deductible
applied by the Florida Insurance Guaranty Association (“FIGA”) in their settlement of claims against the First Alliance
estate. On May 5, 2006, the Receiver mailed out distribution checks. No other distributions are expected in this estate.
On November 6, 2006, the Court issued an Order that discharges the Florida
Department of Financial Services of its duties as Receiver retroactive to November 1, 2006.
Pursuant to the court order, all undelivered distributions will be sent to the
Department of Financial Services, Bureau of
