Can I still report a new claim?
No. On August 10, 2009, the Receiver mailed proof of claim forms to individuals and entities that the Receiver identified as having a possible claim in the Cumberland estate. The proof of claim form mailing also provided a notice that informed claimants of the Receiver's approved Plan of Rehabilitation. To be considered timely filed, claims should have been submitted and postmarked on or before Tuesday, January 26, 2010.
What is the status of my pending claim?
The claim processing procedure set forth in the Motion has been authorized by the Receivership Court. If you need the status on your claim, you may call the Receiver at #850-413-3081 for assistance (toll-free to Florida residents by calling #800-882-3054).
If I have already filed a claim with Cumberland, will the approved Rehabilitation Plan affect the status of my claim?
No. Exhibit "X" of the Receiver's Motion identifies those open pending claims that are on file with Cumberland and already deemed submitted. An additional proof of claim form does not need to be submitted for those claims identified on Exhibit "X".
I was previously offered a settlement amount on my pending claim. However, I did not accept the offer. Is that offer still good?
No. Any previous offers of settlement not accepted and finalized are hereby withdrawn.
If I negotiated a claim settlement with the Receiver previously and agreed to an amount less than my original estimated claim amount, can I file a proof of claim form for the difference?
No. Claims previously settled with the Receiver are final and will not be reopened.
I previously posted collateral with Cumberland. Will my collateral be returned?
The Receivership Court approved the Collateral Release Process set forth in the Receiver’s Motion. In the event that no claim is submitted against the bond (s) for which you posted collateral by the claims filing deadline, the Receiver was authorized to initiate the process for releasing your collateral. If no claim was submitted against the bond (s) for which you posted collateral by the claims filing deadline, the Receiver was authorized to release your collateral. Collateral checks have been mailed.
