Proof of claim forms have been mailed.  Any proof of claim form filed after the claims filing deadline was considered “late filed”.  If you submitted a proof of claim form, you have been notified, in writing, of the Receiver’s recommendation on your claim.

In January 1994, the First Interim Claims Report was filed with the court for one employee claim.

On March 8, 2004, the Second Interim Claims Report was filed and approved by the Second Judicial Circuit Court in and for Leon County, Florida ("Court") for claimant classes 2 through 8.  On March 18, 2004, notices were mailed to claimants who filed a proof of claim in the estate.  The notice informed them of the Receiver’s recommendation concerning the classification and amount of their claim, along with instructions on how to proceed if a claimant objected to the recommendation. All filed objections have been resolved.

Due to additional assets being collected in this estate, a Third Interim Claims Report was filed with the Court.  On February 24, 2005, the Court entered an order approving the report.  On March 3, 2005, the Receiver mailed notices to the 332 claimants who filed a proof of claim in the estate and who had a change in the Receiver’s recommendations on their claims. The notice informs them of the Receiver’s recommendation concerning the classification and amount of their claim along with instructions on how to proceed if a claimant objects to the recommendations.  All objections were required to be filed, in writing, with the Court and the Receiver, and postmarked by April 15, 2005. All filed objections have been resolved.

On February 1, 2006, the Receiver filed a motion with the Court for approval of the Final Claims Report, the Final Distribution Report, Distribution Accounting and approval to make a distribution to claimants in Classes 1 through 3. On February 2, 2006, an order was issued that granted approval for the Receiver to mail additional distribution checks representing 100% of the recommended and adjudicated amount to claimants in Classes 2 and 3. As a result of the order, 2,360 claimants were approved to receive a distribution check. Checks were mailed on February 23, 2006. The majority of the checks amounted to $100 and represent the statutory deductible applied by the Florida Insurance Guaranty Association ("FIGA") in their settlement of claims within this estate.

All undelivered distribution checks from the February 23, 2006 distribution mailing have been sent to the Department of Financial Services, Bureau of Unclaimed Property.  The Bureau of Unclaimed Property may be reached at:
