What is the Florida Insurance Guaranty Association?

The Florida Insurance Guaranty Association (“FIGA”) is a nonprofit corporation statutorily created to provide a mechanism for the payment of claims when an insurance company is ordered liquidated.

What is a covered claim?

A covered claim is defined by Section 631.54, Florida Statutes, and means "an unpaid claim, including one of unearned premium, which arises out of, and is within the coverage, and is not in excess of the applicable limits of an insurance policy..."

What is the deadline for settling a claim with FIGA?

Per Section 631.68, Florida Statutes, the deadline for settling a claim or filing suit against FIGA is one year after the Receiver’s claim filing deadline which for the Poe Companies was June 1, 2007. Since June 1, 2008 is a Sunday, the established date for settling a claim with FIGA is Monday, June 2, 2008.

Can I submit a new loss claim with FIGA after the June 2, 2008 deadline?

Any claim not settled or in litigation by June 2, 2008 will not be considered by FIGA. However, you may still submit a new claim after June 2, 2008 for recording purposes. You will need to take steps to complete any needed repairs in order to mitigate your damages.

After June 2, 2008, a claim may be filed with the Receiver by filing a proof of claim form. All submitted proof of claim forms should include supporting documentation such as invoices and cancelled checks to verify the amount reported on the proof of claim form. Since the Receiver’s claim filing deadline of June 1, 2007 has passed, any filed proof of claim form will be classified as late-filed. The amount of future distributions, if any, to claimants from the Poe Companies is currently unknown.

How do I request a proof of claim form from the Receiver?

When you initially file a claim with FIGA, the Receiver is notified and they will automatically send you a proof of claim form within the normal processes. If it has been two weeks since you filed your claim with FIGA and you have still not received a proof of claim form, you may request one from the Receiver using the “Contact Us” form or by calling the Receiver at 1-850-413-3081

Will FIGA continue to settle loss claims that were filed on or before the June 2, 2008 deadline?

No. Due to the statute of limitations, all claims must be settled by June 2, 2008.

I had a previous loss claim that was handled by FIGA and a settlement amount was reached. If I now find additional damage, will FIGA re-open my loss claim after June 2, 2008?

If I file a proof of claim form with the Receiver after June 1, 2007, which was the Receiver’s deadline for filing a claim against a Poe Company, when will I get paid?

Any proof of claim form filed after the Receiver’s claim filing deadline of June 1, 2007, will be classified as a late-filed claim. All late-filed claims are assigned a lower claimant classification as compared to timely filed loss claims. It will likely be several years before the Receiver is able to determine the amount of distributions, if any, that will be paid on claims against the Poe Companies.

I have a flood policy with a Poe Insurer and I need to file a claim for a loss incurred prior to July 1, 2006. Who do I contact to file my claim?

If you have a flood claim, you must contact National Flood Services, Inc. which is currently servicing the flood business written by the Poe Insurers. Claims may be filed by contacting National Flood Services, Inc. at 1-800-759-8656. The Florida Insurance Guaranty Association is not handling flood claims on behalf of the Poe Insurers.

I have a flood policy with a Poe Insurer and I need to file a claim for a loss incurred on or after July 1, 2006. Who do I contact to file my claim?

The Receiver has sold the flood book to Fidelity National Property and Casualty Insurance Company, another authorized insurance company. Independent agents and policyholders can contact Fidelity National Property and Casualty Insurance Company toll free at (800) 820-3242 or via facsimile at (800) 850-3299. Independent agents can also reach Fidelity National Property and Casualty Insurance Company by visiting their website at www.fidelitynationalflood.com or via e-mail at floodcustomerservice@fnf.com.
