Division of Rehabilitation and Liquidation
When will I receive an Agent Notice?
Agent Notices have been mailed. Copies of the Notices are available in the Related Documents section.
What is my responsibility to the policyholders?
Section 631.341(2), Florida Statutes requires that agents send by certified mail or registered mail to the last known address of any policyholder a written notice of the insurer’s insolvency before the court-ordered cancellation date of the policies, which is September 23, 2009 for all policies other than the automobile warranty policies which were cancelled on August 24, 2009.
Will my earned commission claim be paid by either of the guaranty associations, FIGA or FWCIGA?
No. Agents’ earned commission claims are general creditor claims and are not covered by FIGA or FWCIGA but may be filed as claims in the receivership estate. There may not be sufficient assets to pay this priority of claims; however, you must file a proof of claim form to have your claims considered.
How do I obtain a loss run so I can work with the insured to obtain alternative coverage?
If you need to obtain a loss run, you should contact the Receiver using the "Contact Us" Form or by calling (800) 882-3054.
