Division of Rehabilitation and Liquidation
Will my general creditor claim be paid by a guaranty association?
No. General creditor claims are not covered by a guaranty association, but may be filed as claims in the receivership estate. There may not be sufficient assets to pay this priority of claims; however, you must file a Receiver's proof of claim form to have your claims considered.
All claims must be filed with the Receiver on or before 11:59:59 p.m. on March 1, 2013 (i.e., six months following the entry of the liquidation order) to be considered timely filed. If not, it will be considered a “late-filed” claim. Late filed claims are given a lower claimant class priority and there may not be sufficient assets to pay this priority of claims. A Proof of claim form can be found on the Receiver’s website, www.myfloridacfo.com/Receiver, under Proof of Claim Form General Information.
