The FCCS Division is considering ways to streamline the submission of monthly "bodies handled" reports. Persons or firms who provide or use software that does or might allow export of bodies handled data to a CSV file for forwarding to the Division, are asked to read the attached item.

LATE FEES re PRENEED REMITTANCES TO BE ENFORCED
Commencing with quarterly preneed remittances for 2nd Quarter 2009, which will be due on or before Aug. 31, 2009, the Division will be enforcing late fees for quarterly preneed remittances that are not paid by the due date. The Division has not previously enforced these late fees rigorously because of computer system limitations. For payments sent by mail, payment will be deemed late if the envelope in which payment is received by the Division, is not postmarked on or before the due date. By Board rule, the late fee is $200 for first time you are late, and $400 each time thereafter.

QUARTERLY REMITTANCE FEE PER CONTRACT IS INCREASING JULY 1, 2009
Effective July 1, 2009, the Quarterly Preneed Remittance paid by Preneed licensees will increase by $2 per each preneed contract. The increase will apply to each preneed contract entered into on and after July 1, 2009. The increase will apply to all preneed contracts, whether the contract is secured by trust deposit, life insurance, or surety bond. SCI REQUESTS MODIFICATION OF MENORAH
On 3-10-09 the Division of Funeral, Cemetery, and Consumer Services received from representatives of SCI the attached draft of a “Motion to Modify Settlement Agreement,” in regards to the Menorah Gardens matter pending in Florida Circuit Court. The Division anticipates being asked to provide its position concerning the Motion, to the Circuit Court. If any interested member of the public has any comments they desire to provide the Division in regards to the draft Motion, or in regards to the position the Division should take regarding the draft Motion, such persons should send the comments to the Division by email or letter, so that they are actually received by the Division on or before 3-26-09. NEW PRENEED QUARTERLY INVOICE FORM PROPOSED

To All Interested Parties:
The Division of Funeral, Cemetery, and Consumer Services anticipates putting the attached NEW QUARTERLY PRENEED REMITTANCE FORM into use later this year (we anticipate sending it out in June 2009 for reporting of quarterly preneed remittances for 2d quarter of CY 2009 (April 1-June 30, 2009). Currently and for many years past, each quarter we send each preneed licensee two remittance invoice forms to fill out and return, one form for remittances to the Consumer Protection Trust Fund (CPTF), and another separate form for remittances to the Regulatory Trust Fund (RGTF). The new revised form combines CPTF and RGTF remittances onto the single new form. So preneed licensees would receive only one remittance invoice each quarter, and would remit only one check each quarter. The FCCS Division has scheduled a meeting on Feb 13, 2009, in room 230A of the Alexander Building, from 10 AM to noon, to receive from any interested party, any comment, concerns, or suggestions you have concerning the proposed new form. EMERGENCY ORDER ISSUED
On January 14, 2009 the Department of Financial Services filed an Emergency Order concerning “Morning Glory Funeral Chapel of St. Petersburg, Inc.” (hereinafter “Morning Glory”), located at 3301 5th Ave. South, St. Petersburg, Fla. and Lisa Speights, licensed Funeral Director. The Emergency Order restricts the activities of Morning Glory and Lisa Speights. The restrictions are set forth in the Emergency Order, which may be viewed by clicking HERE. NOTICE OF PUBLIC WORKSHOP

This workshop is for the purpose of receiving public comment concerning the possibility of shifting from a system of quarterly preneed remittances, to a system of annual preneed remittances. Click here for more information.

THE INCREASE OF FINGERPRINTING FEES

Effective July 1, 2008, the fee for the Florida Department of Law Enforcement to process fingerprints and conduct criminal background checks has been increased from $57.25 to $58.25. The fee increase is due to the Legislature’s decision to increase the fee for FDLE criminal history checks.

IMPORTANT NOTICE TO LICENSE APPLICANTS

Be sure to allow adequate time for your license application to be reviewed.

Chapter 497.167(9), Florida Statutes, requires an application to be complete at least 25 days in advance of a regularly scheduled board meeting to be considered by the board at such meeting. The Licensing Unit has internal deadlines for identifying application deficiencies, processing completed applications and submitting applications for board action.

Application processing begins when an application is received in the Licensing Unit. All requirements must be received, reviewed and acted upon two weeks prior to the next board meeting. Board agendas are then produced and all processed applications and documents are copied and submitted to the board members for their review one week prior to the board meeting.

LICENSED ENTITIES – A CHANGE IN BUSINESS LOCATION, OWNERSHIP OR A SUBSTANTIAL MODIFICATION TO THE PHYSICAL PREMISES OF A LICENSED ENTITY
A change of actual physical location, a change in ownership or a substantial modification to the physical premises of a licensed funeral establishment, cinerator facility, direct disposal establishment or centralized embalming facility requires Board approval. The licensed entity is required to submit the change for Board approval using the appropriate entity license type application form.

NAME CHANGE
Effective January 1, 2008, Florida’s testing service for administering funeral professionals license examinations has changed its name from Promissor to Pearson VUE. Pearson VUE previously acquired Promissor and had continued to operate the company under the acquired name. All telephone numbers and test center locations will remain the same.

 

HOT TOPICS

MONUMENT ESTABLISHMENTS AND PROFESSIONALS – ARE YOU LICENSED?
Effective October 1, 2005, Chapter 497, Part V, was amended to distinguish between Monument Builders and Monument Retailers. All licensed monument establishments were made Monument Retailers, and a new application was required to become a Monument Builder. The industry was allowed time to adjust to the new law and become voluntarily licensed. NOTICE: The Division’s field examiners have begun inspecting monument establishments and employees to determine compliance with the current law.

ESTABLISHMENTS SELLING PRENEED CONTRACTS - 2008 LICENSE RENEWAL
Establishments licensed to sell preneed contracts (license types 3700 and 3709) will receive their annual renewal notice beginning April 1, 2008. The notice is for renewal of the primary establishment and any branch operations selling preneed contracts. Licenses that are renewed by June 30, 2008, will be issued effective July 1, 2008.

CONTINUING EDUCATION PROVIDERS – COURSE ROSTERS
The Division uses the DICE electronic data tracking system to manage continuing education data. This system has been enhanced to allow course providers to enter course completion information directly into DICE, from course rosters, by using the attendee’s social security number or FCCS license number.
