PURPOSE AND EFFECT: Section 633.128(1)(e), F.S., requires the Division to issue certificates of competency to persons who, by reason of experience and completion of basic in-service training, advanced education, or specialized training, are especially qualified for particular aspects or classes of firefighting duties. Section 633.406(2), F.S., authorizes the Division to establish by rule additional certificates that the Division may award in recognition of special training or education received by an individual, authorizing that individual to perform specialized firefighting services or provide specialized firefighting instruction, such as hazardous materials and urban search and rescue. Section 633.508(2), F.S., authorizes the Division of State Fire Marshal to adopt rules for the purpose of ensuring safe working conditions for all firefighter employees by authorizing the enforcement of effective standards, by assisting and encouraging firefighter employers to maintain safe working conditions, and by providing for education and training in the field of safety.

SUMMARY: The rule will establish a voluntary certification program for firefighters who desire to perform the duties of a safety officer. The safety officer is the person who is qualified to manage different elements of a fire department safety and health program. A person who completes the program will receive an Incident Safety Officer Certificate of Completion, a Health and Safety Officer Certificate of Completion, or a Safety Officer Certificate of Competency. This program is based on the National Fire Protection Association (NFPA) 1521, Standard for Fire Department Safety Officer, 2015 edition.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department conducted an economic analysis of the potential impact of the proposed rule and determined that there will be no adverse economic impact or regulatory increases that would require legislative ratification.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

PURPOSE AND EFFECT: The proposed rulemaking promulgates a new rule to comply with provisions of subsection 633.138(1), F.S., as provided by Ch. 2013-183, Laws of Florida. The proposed rule requires an individual who is issued a license, permit, or certificate under the provisions of Ch. 633, F.S., to notify the Division of State Fire Marshal (“Division”), in writing, of any changes to her or his current mailing address, e-mail address, or place of employment. The proposed rule further requires individuals to notify the Division within 30 days of any change of record through the Division’s Fire College Department of Insurance Continuing Education (“FCDICE”) information database system.

SUMMARY: The proposed rule is amended to require an individual who is licensed, certified or who is issued a permit, subject to the provisions of Ch. 633, F.S., to notify the Division in writing of any change of record regarding their contact information or place of employment. Subject individuals shall provide such notice within 30 days of any change of record through the FCDICE information database system..

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. PURPOSE AND EFFECT: The proposed rules are amended to conform to certain provisions of Section 633, F.S., “Fire Prevention and Control,” as revised under Chapter No. 2013-183, Laws of Florida. The proposed amendments include the following changes: Form DFS-K4-1038, “Release and Waiver of Liability,” is adopted and incorporated by reference under proposed Rule 69A-37.039, F.A.C.; proposed Rules 69A-37.059 and 69A-37.408, F.A.C., are amended to reflect an expanded period for the renewal of firefighter safety instructor certification, increasing the time period for renewal from three to four years; proposed Rule 69A-37.064, F.A.C., is amended to set forth the requirements for admission to the Florida State Fire College under new subsection (7), which also provides links to the Florida State Fire College website address.

69A-62.024    Standards for Construction, Repair, and Maintenance of Firefighter Employee Places of Employment and Inspection, Repair and Maintenance of Fire Apparatus

PURPOSE AND EFFECT: Paragraph 633.508(7)(a), F.S., authorizes the Division of State Fire Marshal (SFM) to prescribe by rule the safety devices, safeguards, or other means of protection that must be adopted for the prevention of accidents and injuries in every firefighter employee place of employment. The SFM is also authorized to determine what suitable devices, safeguards, or other means of protection for the prevention of occupational diseases must be adopted or followed in any firefighter place of employment. Paragraph 633.508(7)(b), F.S., requires the SFM to ascertain, fix, and order such reasonable standards and rules for the construction, repair, and maintenance of firefighter employee places of employment so as to render them safe.

A firefighter employer shall maintain fire department facilities in accordance with the Florida Fire Prevention Code. A firefighter employer shall follow the repair and maintenance recommendations set forth in section 9.3 of the National Fire Protection Association (NFPA) 1500 (2013 Edition). A firefighter employer shall follow the inspection recommendations set forth in section 9.2 of the NFPA 1500 (2013 Edition). A firefighter employer shall follow the smoke free designation recommendations set forth in section 9.1.7 of the NFPA 1500 (2013 Edition). A firefighter employer shall develop and maintain a schedule for the maintenance, inspection and testing of fire apparatus and equipment as set forth in sections 6.4.1 to 6.4.4 of the NFPA 1500 (2013 Edition).

NOTICE OF CHANGE
Notice is hereby given that the following changes have been made to the proposed rules in accordance with Section 120.54(3)(d)1., F.S., published in Vol. 39, No. 155, August 9, 2013, issue of the Florida Administrative Register.

Form DFS-K4-1477, Application for Fire Officer I Certification, Form DFS-K4-1448, Application for Fire Officer II Certification, Form DFS-K4-2104, Application for Fire Officer III Certification, and Form DFS-K4-2105, Application for Fire Officer IV Certification, were amended to delete a reference to Form DFS-K4-1020 and other technical changes.

Form DFS-K4-2106, Fire Officer I Task Book, and Form DFS-K4-2107, Fire Officer II Task Book, were amended to state that the Division shall designate an alternate evaluator who shall be a Florida Certified Fire Officer and Florida Certified Instructor.

Rule paragraph 69A-37.065(2)(f) has been amended to read:

(f). Courses submitted for equivalency under subparagraphs (2)(a)1., (b)1., (c)1. and (d)1. shall be reviewed by the Bureau of Fire Standards and Training. The Bureau of Fire Standards and Training shall approve any course which meets the criteria provided in this paragraph (2)(f). Requests for approval shall be submitted in writing to the Bureau, 11655 North West Gainesville Road, Ocala, Florida 34482-1486. The following factors shall be used to determine course equivalency: course title, course grade or record of course completion, number of academic credits earned, course hours attended, course description, course syllabus, student learning outcomes, and course objectives. All requests for course equivalency shall include, at a minimum:

1. Name of course;
2. Passage scores and rates;
3. An educational agenda or syllabus;
4. Required number of classroom hours;
5. Description of the course objectives, student learning outcomes, or job performance requirements covered.

Purpose and Effect: The purpose of the proposed rule amendments is to conform Rule 69A-37.0527, F.A.C., “Retention of Certification,” to the provisions of recently enacted amendments and to make other clarifications and updates. The retention requirements and retention time periods were amended by the Florida Legislature in SB1410, which became effective July 1, 2013. The specific effect of the proposed rule amendments is to provide individuals whose firefighter retention status was inactive prior to the implementation of the new Section 633.414 Florida Statutes (2013), a period of one year from the effective date of the proposed rule amendments to become compliant by completing the retention examination.
