Claims Information

How do I report a new claim?

During liquidation, the Florida Workers’ Compensation Insurance Guaranty Association (FWCIGA) steps in and handles the processing and payment of covered loss claims. If you need to file a new claim or check on the status of a pending claim, contact:

North American Risk Services, Inc. (NARS)
PO Box 166002
Altamonte Springs, FL 32716-6002
Phone: 1-800-315-6090 ext. 1321
Fax: 1-866-261-8507

The processing and payment of covered claims will be made subject to the following limits: FWCIGA limits the amount it pays to the amount of coverage provided by the policy. However, Florida does not limit benefits paid to injured workers and pays 100 percent of the statutorily defined workers’ compensation benefits. Employer liability claims are limited to the lesser of $300,000 or policy limits. For unearned premium claims, FWCIGA’s obligation is limited to $50,000 and covers only policies in force on the date of liquidation.

If I have already filed a claim with Southern Eagle, will the Liquidation affect the status of my claim?

No. During liquidation, the Florida Workers’ Compensation Insurance Guaranty Association (FWCIGA) will step in and handle the processing and payment of covered loss claims. Florida does not limit benefits paid to injured workers and pays 100 percent of the statutorily defined workers’ compensation benefits. There is a lawsuit being brought against me for bills that Southern Eagle should have paid. What should I do?

Notify FWCIGA by contacting North American Risk Services, Inc. (NARS) at 1-800-315-6090.

Is there a deadline for filing claims?

Yes. The Receiver's deadline for filing a claim against the estate of SEIC is 11:59:59 p.m. on December 16, 2012, to be considered as timely filed. Claims filed after the deadline will be accepted, however, the class of the claim will be lower, reducing the likelihood that monies will be available to pay your claim.

FWCIGA will process loss claims relating to perils covered under your workers’ compensation policy and will cover unearned premium claims on your insurance policy that was cancelled by the liquidation order (so long as your policy was in force as of the date of liquidation which was January 15, 2012).
