Return Premium Claimant Information

I have a claim for return of unearned premium. What should I do?

The refund process is defined by Florida Statutes, Chapter 631. Claims for unearned premium on your automobile warranty agreement or service agreement may be considered claims against the IMSC estate.

In order to protect your right to any unearned premium claim, you must submit a proof of claim form to the Receiver. On December 16, 2010, the Receiver mailed proof of claim forms to all known warranty agreement owners in order to give them the opportunity to file their unearned premium claim prior to the claim filing deadline of February 28, 2011. There were a small number of letters sent claimants that previously submitted their unearned premium claim to the Receiver on a claim inquiry form while the company was in rehabilitation. If you do not receive a letter acknowledging your claim or if you don't receive a proof of claim form with the claimant type, "Unearned Premium", pre-printed on the proof of claim form, the Receiver has no record of your unearned premium claim. You will need to contact the Receiver to request a proof of claim form so you can file your claim prior to the claim filing deadline of February 28, 2011.

It is currently unknown when, and if, you will receive a refund of your unearned premium.
