Now that my insurance company is in Liquidation, who will adjust claims?

FLAHIGA has taken over AvaHealth’s obligations to pay all valid policyholder claims incurred during the life of the policy, subject to statutory limits. Consumers with questions regarding AvaHealth claims should contact the Third Party Administrator (TPA) retained by FLAHIGA to provide administrative and claims processing services for AvaHealth at (847) 803-9629.

If you believe you will incur out of pocket expenses as a result of the liquidation or otherwise believe you are owed monies by this company, you will need to complete a proof of claim form and file it with the Receiver. The Receiver has posted a proof of claim form on the Receiver’s website, www.myfloridacfo.com/division/Receiver, under Proof of Claim Form General Information.

Do guaranty associations have limits on the covered claims they process and pay?

Yes. The Florida Life and Health Insurance Guaranty Association (FLAHIGA), will pay all policyholder valid claims incurred during the life of your policy, subject to statutory limits. FLAHIGA will do this for a limited time, subject to a $300,000 statutory limit and other applicable Florida statutory law.

What is a covered claim?

A covered claim is defined by Section 631.54, Florida Statutes, and means "an unpaid claim, including one of unearned premium, which arises out of, and is within the coverage, and is not in excess of the applicable limits of an insurance policy..."

There is a lawsuit being brought against me. What should I do?
