Premium Refund Information

I am a National Group policyholder whose policy was cancelled as a result of the liquidation. When am I getting my return premium refund?

Upon liquidation, the Florida Insurance Guaranty Association ("FIGA") is responsible for paying claims for premium refunds/unearned premium. The Receiver has completed its analysis of the company's policy records and refund checks will be mailed by the end of January, 2012. A $100 statutory deductible will be taken from the amount owed. If the premium refund due is $100 or less, a refund will not be processed by or on behalf of FIGA. A policyholder may have a claim in the Northern Group liquidation proceeding for the $100 deductible or the gross refund less than $100.

The Receiver will be seeking permission from the Receivership Court to deem file unearned premium claims of $100 or less as filed without any proof of claim filing requirement by claimants. No action will be required by unearned premium claimants.

If I cancelled my policy on or after October 10, 2011 but prior to the November 9, 2011 liquidation date, will I get a full refund or will $100 be deducted from my refund? When will the refund be processed?

All cancellations processed on in-force policies after the company was placed into receivership on October 10, 2011 will incur the $100 statutory deductible. If the gross refund is less than $100, you will not receive a check at this time but will have a claim in the estate.

I am owed a return premium refund but have not received a check. What do I do?

Return premium checks will be processed and mailed by the end of January, 2012, to all known policyholders that are owed return premium which exceeds $100. If you have not received your check by mid-February, please contact the Receiver for assistance.

I need to have my premium refund check re-issued because of an incorrect or deceased payee being listed. What do I do?

If you need your check re-issued, please write void across the check face and mail the check to the below address along with a cover letter explaining why the check needs to be re-issued. If the re-issue is a result of a name change, you will also need to complete a change of name form and mail it in along with supporting documentation to support the name change. If my policy was financed by a premium finance company, will I receive the refund check?

If a policy was financed by a premium finance company, the refund check will be sent to the premium finance company but will be made out to both the policyholder and the premium finance company. The two parties will then both need to endorse the check before it can be presented for payment.

The receivership process is lengthy and typically takes several years to complete. Your claim may be paid on a pro-rata basis, to be determined by available funds, after all legal and collection activity have ceased.
