What is the status of my pending claim?
Processing and payment of commercial automobile and commercial property covered claims are being handled by the Florida Insurance Guaranty Association (you are leaving the DFS website and opening a new browser window) ("FIGA"). FIGA pays covered claims up to a maximum of $300,000 per claim. Additionally, there is a $100 statutory deductible per claim. You may call FIGA at (800) 988-1450 to find out the status of your claim.
If I reported my claim to NGIC, must I start over with FIGA?
No. FIGA has access to the company claim files and will handle your claim.
Where should I report a new loss claim?
When a property and casualty company such as NGIC goes into liquidation, the Florida Insurance Guaranty Association ("FIGA") steps in and handles the processing and payment of covered loss claims. You may contact FIGA by calling (800) 988-1450 or by mail at the following address:

How much will be paid on my claim?
FIGA will pay covered claims up to policy coverage or up to a maximum of $300,000. All claims paid by FIGA are subject to a $100 statutory deductible. Claims for the $100 deductible and/or in excess of $300,000 may be claims against the estate of NGIC and may be submitted to the Receiver by filing a proof of claim form. There is a lawsuit being brought against me for bills that NGIC should have paid. What should I do?
You should contact FIGA immediately at (800) 988-1450. Just as the insurance company would have done if it were still solvent, FIGA will determine if you are entitled to receive legal defense.
Do I need to submit a proof of claim form to the Receiver in order to have FIGA make payments on my loss claim?
No. FIGA has access to the company claim files and will review your claim to determine if it is a covered claim on which payments may be due. FIGA is allowed a $100 statutory per-claim-deductible; the maximum statutory FIGA payment is $300,000.
I have a claim for return of unearned premium. What do I do?
The refund process is defined by Florida Statutes, Chapter 631. The Receiver's office is responsible for determining the calculation of each unearned premium refund. Once the calculations are complete for the above listed lines of business, the refund amount is forwarded to the Florida Insurance Guaranty Association ("FIGA") and they will issue checks for unearned premium claims in excess of $100. FIGA does not cover claims of $100 or less. If you have questions about the refund check amount you received, you should contact the Receiver for assistance. FIGA does not have a breakdown of the calculation and will not be able to provide assistance on these issues.
The Receiver will seek court approval to deem file unearned premium claims not paid by FIGA. These claims will include the first $100 not covered by FIGA or for any gross unearned premium claim that is less than $100. These amounts are now claims against the National Group estate. No action is required by unearned premium claimants.
What are the deadlines for filing a claim?
The Receiver's deadline for filing a claim against the estate of NGIC is October 10, 2012. The deadline for FIGA to settle claims is one year after the Receiver's deadline per Section 631.68, Florida Statutes. Since the Receiver's deadline is October 10, 2012, FIGA's deadline for settling claims is October 10, 2013 unless a lawsuit was initiated.
Can I file a proof of claim form in the NGIC estate after the filing deadline? Will it be considered late-filed?
Yes, you may file a proof of claim. However, any proof of claim form postmarked after October 10, 2012 will be processed as late-filed.
