Premium Refund Information

I am a HomeWise policyholder whose policy was not assumed by another carrier or was cancelled prior to the November 1, 2011 assumption date. When am I getting my return premium refund?

Upon liquidation, the Florida Insurance Guaranty Association (“FIGA”) is responsible for paying claims for premium refunds/unearned premium. The unearned premium will be returned to you as quickly as possible after the Receiver has completed its analysis of the policy records. A $100 statutory deductible will be taken from the amount owed. If the premium refund due is $100 or less, a refund will not be processed by or on behalf of FIGA. A policyholder may have a claim in the HomeWise liquidation proceeding for the $100 deductible or the gross refund less than $100.

The Receiver intends to petition the Receivership Court to deem file unearned premium claims of $100 or less as filed without any proof of claim filing requirement by claimants. No action is required by unearned premium claimants at this time.

If I cancelled my policy prior to November 1, 2011 which was the assumption date or prior to HomeWise being placed into liquidation on November 18, 2011, will I get a full refund or will $100 be deducted from my refund? When will the refund be processed?

All cancellations that were not processed and mailed will incur the $100 statutory deductible. If the gross refund is less than $100, you will not receive a check at this time but will have a claim in the estate.

I am owed a return premium refund but have not received a check. What do I do?

All eligible unearned premium refunds were mailed by mid-May, 2012. If you have not received your check, please contact the Receiver for assistance.

I need to have my premium refund check re-issued because of an incorrect or deceased payee being listed. What do I do?

If you need your check re-issued, please write void across the check face and mail the check to the below address along with a cover letter explaining why the check needs to be re-issued. If the re-issue is a result of a name change, you will also need to complete a change of name form and mail it in along with supporting documentation to support the name change. How do I file a claim for the $100 deductible or for a return premium claim that is $100 or less?

When will I receive payment of my $100 deductible or return premium of $100 or less from the estate of HomeWise?

The receivership process is lengthy and typically takes several years to complete. Your claim may be paid on a pro-rata basis, to be determined by available funds, after all legal and collection activity have ceased.
