I am an American Keystone policyholder whose policy was cancelled as a result of the liquidation. When am I getting my unearned premium refund?

The Florida Insurance Guaranty Association (“FIGA”) will pay claims for premium refunds/unearned premium after the Receiver completes the processing of the policy records and sends unearned premium records to FIGA. On December 23, 2009, FIGA mailed premium refunds on the personal lines policies. For the commercial lines policies, return premium checks were issued in April 2010. A $100 statutory deductible will be taken from the amount owed. If the premium refund due is $100 or less, a refund was not processed by FIGA.

All $100 statutory deductibles on unearned premium claims and unearned premium claims that are less than $100 are a claim against the estate of American Keystone. The Receiver has received court approval to deem all unearned premium claims as timely filed. This means that unearned premium claimants have a claim in the American Keystone estate without having to file a proof of claim form. Therefore no action is required by unearned premium claimants. I have received an unearned premium refund check on my personal lines policy (residential) but I don't understand how the return premium was calculated. What do I do?

Unearned premium calculations were made by Receiver using a formula to pro-rate your premium according to the number of days that your policy was in force prior to it being cancelled November 9, 2009 due to the liquidation court order (or prior to November 9, 2009 if it was previously cancelled).

I have received an unearned premium refund check on a commercial lines policy (condo policy) but I don't understand how the return premium was calculated. What do I do?

Due to the complexities of the unearned premium calculation for a cancelled commercial lines policy, there is not an on-line calculator to utilize to verify the amount of your premium refund. If you have questions about the calculation, please contact the Receiver's office for assistance. Do not contact FIGA because they will not be able to assist you with explaining the calculation.

I am owed an unearned premium refund but have not received a check. What do I do?

Return premium checks will be processed and mailed to all known policyholders that are owed return premium which exceeds $100. If you had a personal lines policy (homeowners policy), return premium checks were mailed on December 23, 2009 and you should have received your check by now. If you had a commercial lines policy (condo policy), your refund check was mailed in April 2010. If you feel you are owed a return premium check or if you have other questions about the status of your return premium claim, you may contact the Receiver for assistance.

When will I receive payment of my $100 deductible or return premium of $100 or less from the estate of American Keystone?

The receivership process is lengthy and typically takes several years to complete. Your claim may be paid on a pro-rata basis, to be determined by available funds, after all legal and collection activity has ceased.
