When will I receive an Agent Notice?

The Florida Agent Notice was e-mailed to all known agents of the company from AequiCap’s corporate offices on March 16, 2011 alerting agents of the liquidation of Aequicap. In addition, The Florida agent notice was mailed to all known Florida agents on March 16, 2011. A separate South Carolina agent notice was mailed to South Carolina agents on March 29, 2011.

Policyholder notices have been mailed to policyholders in Florida, Georgia, Oklahoma and South Carolina. Copies of all notices are available on the Florida Receiver’s website by clicking here.

What is my responsibility to the policyholders?

Section 631.341(2), Florida Statutes requires that agents send by certified mail or registered mail to the last known address of any policyholder a written notice of the insurer’s insolvency within 15 days subsequent to the date of the agent notice, unless the agent has replaced the coverage with a solvent authorized insurer.

Will my earned commission claim be paid by the guaranty associations?

No. Agents’ earned commission claims are general creditor claims and are not covered by guaranty associations but may be filed as claims in the receivership estate. There may not be sufficient assets to pay this priority of claims; however, you must file a proof of claim form to have your claims considered.

The Receiver has not yet begun the proof of claim filing process. Once the proof of claim process begins, information will be posted to this website on how you can obtain a proof of claim form.

How do I obtain a loss run so I can work with the insured to obtain alternative coverage?

If you need to obtain a loss run, you should contact the Florida Department of Financial Services, who is the court appointed receiver of AequiCap. Call 800-882-3054 (toll-free to Florida residents) or call (850) 413-3081. You may also use the "Contact Us" form on this website.
