We continue to see a pattern of noncompliance in the areas noted below. This section has been created to assist you in keeping your insurance business in compliance. The items are intended as reminders only and are not necessarily the exact text of the Florida Statutes or Florida Administrative Code. The legal cites have been provided for your further reference.


Advertising
Life and health advertising must have the prior approval of the benefiting insurance company before being disseminated. Any advertisements approved by the insurer should be used exactly as approved. [Rule 69B-150.013(10), Florida Administrative Code]

Applications for Policies
Applications for an insurance policy or annuity contract should include the legible name and license identification number of the agent as shown on the agent's license issued by the department. [Section 627.4085, Florida Statutes]

Customer Representatives
All licensed customer representatives must be appointed by either a duly licensed and appointed general lines agent or a general lines insurance agency before he or she can conduct insurance business. The general lines agent who appoints the customer representative, or the designated supervising agent, is responsible for supervising the work and the conduct of the customer representative while that person conducts insurance business. A customer representative can only be appointed by one agent or agency at any one time.  [Section 626.7353, Florida Statutes]
