  • 00-57 Neutral Evaluator

Florida Statute 627.7074(1)(b) defines a "neutral evaluator" as a professional engineer or a professional geologist who has completed a course of study in alternative dispute resolution designed or approved by the department for use in the neutral evaluation process, who is determined to be fair and impartial.

All applicants must file an application under oath to the department for approval (Click here for the Neutral Evaluator application) (go here for PDF version).

 State Qualifications (Must be completed within the last four years):

  • Applicant must have successfully completed a 40 hours training program in alternative dispute resolution, which has been approved by the Department of Financial Services; and

  • Applicant must be a Professional Engineer or Professional Geologist; and
     

  • Applicant can not be currently employed by a property insurer, property insurance adjuster, or adjusting firm; and
     

  • Applicant, or a business entity which he/she is affiliated with, can not have obtained more than 90% of its gross income or revenue in the past calendar year from contracts with property insurers or persons acting on behalf of property insurers, exclusive of fees generated through the sinkhole neutral evaluation program; and
     

  • Applicant, or a business entity which he/she is affiliated with, can not have obtained more than 90% of its gross income or revenue in the past calendar year from contracts with property insurance claimants or persons acting on behalf or property insurance policyholders.
