Case Notes

The following are instances in which licensees or other persons violated the Florida Insurance Code and the administrative action the department has taken against them.
Note: All administrative investigations are subject to referral to the Division of Insurance Fraud for criminal investigation.


Case: An investigation of a bail bond agent alleged that he solicited bail bond business on the grounds of a jail and failed to maintain proper bail bond records.
Disposition: License suspended for 3 months.

Case: An investigation of an insurance agency alleged that a corporate officer failed to forward insurance premiums exceeding $15,000 to an insurer and a premium finance company, failed to timely notify the Department of a change of business address, and failed to provide documents at the request of the Department.
Disposition: License revoked.

Case: An investigation of a health agent alleged that he acted as an insurance agent prior to obtaining his license, and that he misrepresented the terms and conditions of health insurance policies to consumers.
Disposition: License revoked.

Case: An investigation of a general lines agent alleged that she failed to place insureds with admitted carriers and issued "Statement of Diligent Effort" forms containing misleading information.
Disposition: Probation for 12 months and fined $5,000.

Case: An investigation of a customer representative alleged that he misappropriated fiduciary funds and failed to provide a change of business address to the Department.
Disposition: License suspended for 12 months, must pay $3,802.75 in restitution, and other terms.

Case: An investigation of an all lines company adjuster alleged that he submitted fraudulent property claim loss reports and diverted claims settlement checks.
Disposition: License revoked and permanently barred from the insurance business.

Case: An investigation of a life, including variable annuity & health and general lines agent, alleged that she used misleading advertising in the solicitation of insurance products.
Disposition: Fined $1,500 and ordered to cease & desist from using misleading advertisements.

Case: An investigation of a title insurance agent alleged that she failed to disburse escrow funds to appropriate mortgagees.
Disposition: License revoked.

Case: An investigation of a public adjuster alleged that he altered a contract for public adjusting services, submitted agreements not containing the true signature of the client, failed to designate a primary adjuster, and failed to maintain a surety bond.
Disposition: License revoked.
